Patent Holder Asks Fed. Circ. To Clarify Alice In Netflix Case

By Kelly Knaub (December 22, 2015, 11:41 PM EST) -- Broadband iTV and other so-called former practicing entities and patent holders urged the Federal Circuit on Friday to clarify patent eligibility under the Supreme Court's Alice decision, saying a district court misapplied the law when it invalidated five Rovi patents asserted against Netflix.

Along with former practicing entities Double Rock Corp., Island Intellectual Property LLC, Access Control Advantage Inc. and technology start-up Fairway Financial U.S. Inc., Broadband said that confusion among district courts resulting in overzealous application of the law on patent-eligibility under Alice is harming patent owners, inventors and the marketplace.
