8th Circ. Nixes Enviro Appeal Of Reservoir Rebuild

Law360, New York (October 24, 2008, 12:00 AM EDT) -- A federal appeals court on Thursday denied an environmental group's petition to review a U.S. energy regulator's decision authorizing the reconstruction of the damaged Taum Sauk reservoir in the Missouri Ozarks.

Arguing the authorization violated the National Environmental Policy Act, the Missouri Coalition for the Environment and the Missouri Parks Association petitioned the U.S. Court of Appeals for the Eighth Circuit in September for the review.
