Allstate Urges Fla. High Court To Mull Personal Injury Issue

Law360, Miami (December 22, 2015, 10:57 PM EST) -- Allstate Insurance Co. urged the Florida Supreme Court on Monday to take up its appeal of a ruling that it wrongfully limited its reimbursements under Medicare fee schedules for personal injury protection claims, citing an appellate split on the issue that has created confusion in the lower courts.

The insurer said the high court should exercise its jurisdiction and take up its appeal of the Fourth District Court of Appeals' ruling that a bare reference to the state's personal injury protection statute didn't constitute sufficient notice that the insurer was electing to employ the Medicare fee schedules.
