DHS Poised To Challenge 'No-Match' Injunction

Law360, New York (October 24, 2008, 12:00 AM EDT) -- The U.S. Department of Homeland Security will try to get a judge to lift an injunction that stymied a rule calling for employers to fire workers whose names don’t match their Social Security numbers if the discrepancy can't be rectified, once additional rulemaking proceedings aimed at addressing the court’s concerns are completed.

A newly adopted Supplemental Final Rule will be published in the Federal Register within about two weeks, after which the DHS will move to vacate the injunction and also seek summary judgment from the...
