Citrucel Supplier Can Sue Chemical Maker: Court

Law360, New York (October 27, 2008, 12:00 AM EDT) -- In a lawsuit stemming from a 2006 recall of GlaxoSmithKline’s soluble fiber product Citrucel, the maker of a flavoring chemical for the product can be held liable for damages to an intermediary supplier, a judge ruled on Thursday.

Judge Henry E. Autrey of the U.S. District Court for the Eastern District of Missouri said that ICL Performance Products LP, the maker of the orange-flavoring chemical, will not be dismissed from a fourth-party counter-suit filed by chemical supplier Brenntag Great Lakes LLC.
