Judge Bats Down Ethyl's Bid To Toss Toxic Mill Case

Law360, New York (October 29, 2008, 12:00 AM EDT) -- A district judge has partially rejected Ethyl Corp.'s motion to dismiss the complaint brought by Moraine Properties LLC, ruling that the Ohio company had met the necessary criteria to continue to pursue its claims over cleanup of a toxic paper mill site.

On Monday, U.S. District Judge Thomas Rose partially dismissed Ethyl's bid to have the case tossed out, ruling that assignee Moraine had the right to file a claim under the Comprehensive Environmental Response, Compensation and Liability Act.
