EU High Court Finds For Dutch On Diesel Exemption

Law360, New York (November 6, 2008, 12:00 AM EST) -- The European Union's highest court annulled a decision by the European Commission Thursday that prevented the Netherlands from exempting its diesel vehicles from certain pollutant emissions standards.

The Court of Justice of the European Communities sustained the Dutch appeal of a decision by the EU's Court of First Instance in favor of the commission and ordered it to reconsider its ruling.
