Appeals Ct. Nixes Worker Death Case V. GE Unit

Law360 (November 6, 2008, 12:00 AM EST) -- An appeals court in North Carolina has handed General Electric Lighting Systems Inc. a win in a lawsuit over the carbon monoxide poisoning death of an employee, finding no evidence that GELS knew its conduct would cause serious injury or death and sending the case back to the trial court for dismissal.

The North Carolina Court of Appeals handed down its ruling on Tuesday siding with GELS in the defendant's interlocutory appeal of the trial court's decision not to award GELS summary judgment in October 2007....
