Fla. Supreme Court Hears Tobacco Liability Case

Law360, New York (November 7, 2008, 12:00 AM EST) -- Tobacco company Liggett Group Inc. is trying to persuade Florida's highest court that a plaintiff must prove the existence of a safer cigarette design in order to prevail on a strict liability design defect claim.

In oral arguments before the Supreme Court of Florida on Thursday, Liggett's lawyer said that a Florida appeals court misapplied the law when it upheld a $545,000 jury verdict for a plaintiff who had sued the company for injuries she allegedly suffered as a result of smoking Liggett's Chesterfield cigarettes....
