6th Circ. Upholds NLRB Fineberg Ruling

Law360, New York (November 10, 2008, 12:00 AM EST) -- An appeals court has upheld a National Labor Relations Board decision, overturning an administrative law judge’s finding that the management at Fineberg Packing Co. Inc. wrongfully terminated workers after condoning a strike.

The opinion, filed on Friday by a three-judge panel for the U.S. Court of Appeals for the Sixth Circuit, dismissed an appeal filed by Billy Exum, who worked at the Fineberg meatpacking plant in Memphis, Tenn., where an uncondoned strike broke out in early 2001.
