Drug Co. Sues USPTO Over Patent Term Adjustment

Law360, New York (November 11, 2008, 12:00 AM EST) -- Ironwood Pharmaceuticals Inc. has filed suit against the U.S. Patent and Trademark Office, seeking to have the patent term adjustment for its constipation drug extended by close to a year.

Cambridge, Mass.-based Ironwood filed the suit Friday in the U.S. District Court for the District of Columbia. It claims that because it took the USPTO more than three years to issue the patent from the date the application was filed, the company is entitled to an extension.
