Sinclair's Bad Faith Claim Allowed In $4.5M Coverage Suit
Law360, Los Angeles (March 11, 2016, 5:03 PM EST) -- A Wyoming federal judge ruled Thursday that a Sinclair Oil Corp. unit can assert a bad faith claim against insurer Infrassure Ltd. in a dispute over $4.5 million in coverage for an explosion at a refinery, determining that Wyoming law applies to the claim rather than more restrictive New York law.
U.S. District Judge Nancy D. Freudenthal rebuffed a bid by Switzerland-based Infrassure to dismiss Sinclair Wyoming Refining Co.'s bad faith and declaratory judgment claims, while granting the insurer's request to dismiss the oil company's claim for an anticipatory breach of contract, albeit without prejudice.
