Ink Cartridge Suit Against HP, Staples Dismissed

Law360, New York (November 17, 2008, 12:00 AM EST) -- A federal judge has thrown out a putative class action antitrust suit against Hewlett-Packard Co. and Staples Inc., rejecting the argument that an arrangement between HP and Staples, which the plaintiff said stymied competition in the market for ink-jet printer cartridges, constituted a per se violation of the Sherman Act.

Judge Rya W. Zobel of the U.S. Court for the District of Massachusetts signed off on a memorandum and order Monday granting the defendants' joint motion to dismiss, which they filed March 5.
