6th Circ. Orders Biscuit Co. To Allow Union Election

Law360 (November 18, 2008, 12:00 AM EST) -- Union organizers can hold a new election at Consolidated Biscuit Co. and the company must reinstate two terminated pro-union employees, an appeals court has ruled, affirming an earlier decision by the National Labor Relations Board.

The U.S. Court of Appeals for the Sixth Circuit issued the decision Friday, giving the baked goods company employees a second chance to vote on whether to be represented by the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union after an initial election was held in August 2002.
