Law360, New York (November 19, 2008, 12:00 AM EST) -- A federal appeals court has rejected a challenge to a trial judge's decision to throw out a discrimination and retaliation case brought by a man who sued Florida's Department of Environmental Protection under the Americans with Disabilities Act, claiming that he lost his job because he was morbidly obese.
