Law360 (November 20, 2008, 12:00 AM EST) -- Fuming over Kansas Gov. Kathleen Sebelius' decision to put the kibosh on a power plant expansion, Sunflower Electric Power Corp. has sued to advance the project, alleging political ambitions motivated an unjustifiable permit refusal.
The complaint, lodged Monday in the U.S. District Court for the District of Kansas, claims the governor and her appointees violated Sunflower's rights and federal law when they denied the power company an air quality permit last year, ostensibly to prevent global warming.
