Sierra Club Sues Coal Co. For Fouling Rivers

Law360 (November 25, 2008, 12:00 AM EST) -- Finding regulators slow to act, the Sierra Club and a West Virginia environmental group have taken Powellton Coal Co. LLC to court, alleging the mining company routinely dumps its waste into neighboring rivers rather than follow surface mining regulations.

The complaint, lodged Monday in the U.S. District Court for the Southern District of West Virginia, claims that Powellton has ignored the costly waste disposal standards required by the Clean Water Act and instead discharged mining waste into waters adjacent to its work sites.
