Airport Van Drivers Not Exempt From OT: 11th Circ.

Law360 (December 2, 2008, 12:00 AM EST) -- A federal appeals court has revived an airport shuttle van driver's putative overtime class action against Southern Shuttle Services Inc., ruling that the driver's claims do not fall under the taxicab exemption to overtime provisions in the Fair Labor Standards Act.

The U.S. Court of Appeals for the Eleventh Circuit issued its ruling Friday, reversing a district court's June decision to dismiss the case based on the FLSA exemption.
