EPA, Army Revise Clean Water Act Guidelines

Law360, New York (December 3, 2008, 12:00 AM EST) -- The U.S. Army and the U.S. Environmental Protection Agency have released new, but only slightly altered, 2007 Clean Water Act guidelines, responding to criticism over CWA policy revisions in the wake of a controversial U.S. Supreme Court decision.

The new guidelines, issued Wednesday, clarify the bodies of water protected under the act, and they replace earlier guidelines issued after Rapanos v. U.S., a landmark U.S. Supreme Court case over CWA jurisdiction.
