Qwest Sues Colorado Regulator Over FCC Rules

Law360 (December 9, 2008, 12:00 AM EST) -- Telecommunications company Qwest Corp. has sued the Colorado Public Utilities Commission and its three commissioners, claiming the agency misinterpreted federal rules when it ordered Qwest to provide its unbundled network elements to competitors at cost-based rates.

In a complaint to the U.S. District Court for the District of Colorado on Friday, Qwest claims the commission improperly applied the U.S. Federal Communication Commission's method of establishing whether a competitive local exchange carrier would be impaired, under the Telecommunications Act, absent access to parts of its network....
