High Court OKs Use Of State Laws In Tobacco Suits

Law360 (December 15, 2008, 12:00 AM EST) -- In a major blow for the tobacco industry, the U.S. Supreme Court has ruled that smokers may use state deceptive-practices laws to sue cigarette manufacturers for the way they market light or low tar brands.

The 5-4 split decision on Monday appears to be a U-turn for the high court, departing from two recent rulings that favored the federal-preemption defense to state consumer protection law cases. But whether the opinion signals a new approach by the court remains to be seen.
