Green Groups Sue To Bury New Mining Waste Rule

Law360, New York (December 29, 2008, 12:00 AM EST) -- A coalition of environmental groups has sued to overturn a U.S. Office of Surface Mining rule that critics say would allow surface coal mining within 100 feet of streams, in violation of several federal laws.

The suit, filed Dec. 22 in the U.S. District Court for the District of Columbia by Coal River Mountain Watch and seven other groups including the Waterkeeper Alliance and the Sierra Club, claims that the new rule will decimate existing stream buffer requirements for coal mining operations by making valley fills...
