Constellation, Residents Settle For $54M Over Fly Ash

Law360, New York (December 31, 2008, 12:00 AM EST) -- A Baltimore City judge on Tuesday approved a $54 million settlement after homeowners in a nearby Maryland county accused Constellation Energy Inc. of contaminating their wells by dumping tons of toxic coal ash into a quarry near their homes.

The settlement, in the Circuit Court for Baltimore City, provides for the connection of 84 homes previously supplied by well water to public water, remediation of the former quarry site and the establishment of two trusts to compensate property owners, according to the plaintiffs' attorney, Hassan Murphy...
