Judge Lets Vanderbilt Out Of Invitrogen Patent Suit

Law360 (January 5, 2009, 12:00 AM EST) -- A federal judge has let Vanderbilt University off the hook in a patent lawsuit filed by Invitrogen Corp. seeking a declaration that Invitrogen does not infringe a Vanderbilt patent, licensed to Oxford Biomedical Research Inc., related to recombinant protein technology.

Magistrate Judge Stephen L. Crocker of the U.S. District Court for the Western District of Wisconsin ruled Dec. 30 that the court lacked personal jurisdiction over Vanderbilt because Vanderbilt has little presence in the state. Oxford remains a defendant in the lawsuit.
