Judge Tosses Antitrust Suit Over Tobacco Settlement

Law360, New York (January 6, 2009, 12:00 AM EST) -- A federal judge has thrown out an antitrust suit against a group of cigarette manufacturers and 52 attorneys general that alleged a 1998 master settlement agreement between them created obstacles for new entrants trying to break into the lucrative tobacco industry.

Judge Jennifer Coffman of the U.S. District Court for the Western District of Kentucky on Monday granted motions to dismiss the suit brought by Mayodan, N.C.-based General Tobacco, saying the pact did not amount to a conspiracy that violated antitrust laws.
