P&G Resolves Olay Trade Dress, Patent Spat

Law360, New York (January 6, 2009, 12:00 AM EST) -- Procter & Gamble Co. has settled a lawsuit over CVS Pharmacy-brand skin-care products that it claims had infringed the patents and trade dress for its Olay Regenerist brand.

The judge finalized a consent judgment between P&G and Fruit of the Earth Inc., which makes the CVS Pharmacy products, on Dec. 30, an agreement in which Fruit of the Earth promised to revise its products and to recognize P&G patents and trade dress.
