Kroes Blasts Spanish Protectionism In Letter

Law360, New York (August 7, 2006, 12:00 AM EDT) -- European Commission Competition Chief Neelie Kroes has accused Spain’s competition authority of “obstructing the free circulation of capital” by imposing conditions on the pending takeover of Spanish energy company Endesa SA by German utility E.On AG.

In a letter leaked to the German paper Der Spiegel, Kroes took a firm stance against Spanish protectionism, claiming that the conditions mandated by Spain’s Comisión Nacional de Energia were not consistent “with the principles of equality and nondiscrimination” set forth by the E.C.
