WVa Teachers Win Injunction Against Drug Tests

Law360, New York (January 12, 2009, 12:00 AM EST) -- A federal judge has issued a preliminary injunction order against school officials in a West Virginia county, banning them from enforcing a random drug test policy on teachers.

In an opinion issued Thursday, Judge Joseph Goodwin ruled that the privacy of school employees trumped the safety issues used as justification by the Kanawha County Board of Education for subjecting its teachers and other public employees to its new mandatory testing policy.
