Trial Lawyers Call For Preemption Overhaul

Law360 (January 12, 2009, 12:00 AM EST) -- A lobby group for U.S. trial lawyers has called on the forthcoming Obama administration to overturn current federal preemption policy that it claims has afforded “complete immunity to negligent corporations” and deprived Americans of their right to sue under state consumer protection laws.

The American Association for Justice on Monday urged the President-elect to reverse Bush-era regulations by federal agencies and issue an immediate stay memorandum on all proposed and pending rules that extend federal preemption immunity to corporations.
