EPA Updates Industry Operating Permit Program

Law360, New York (January 14, 2009, 12:00 AM EST) -- Touting the environmental, economic and administrative benefits of so-called flexible air permits, U.S. regulators on Tuesday revised the operating permit program under the Clean Air Act to encourage flexible permit use among major industries.

The U.S. Environmental Protection Agency’s action, which modifies rather than overhauls the existing permitting program, is designed to provide a flexible and market-responsive alternative to conventional construction and operational permitting procedures for major industrial facilities.
