Wal-Mart Drivers Race Bias Class Suit OK To Proceed

Law360, New York (January 15, 2009, 12:00 AM EST) -- A federal judge has allowed a class action brought by black truck drivers who allege that Wal-Mart Stores Inc.’s practice of recruiting drivers mainly through word of mouth is discriminatory to go forward, denying several motions by the company.

Judge William R. Wilson of the U.S. District Court for the Eastern District of Arkansas on Tuesday denied motions by Wal-Mart for summary judgment on the plaintiffs' class allegations, decertification of the class and exclusion of some of the plaintiffs' expert testimony.
