Whole Foods, FTC Battle Heads To DC Circ.

Law360 (January 15, 2009, 12:00 AM EST) -- In an attempt to speed up its lawsuit against the U.S. Federal Trade Commission over alleged due process violations, Whole Foods Market Inc. has given up its fight over jurisdiction, agreeing to take the case to the appeals court level.

The natural foods grocer voluntarily dismissed the case Thursday in the U.S. District Court for the District of Columbia, refiling it in the U.S. Court of Appeals for the District of Columbia Circuit.
