5th Circ. Tosses EEOC Case Against Agro

Law360, New York (January 16, 2009, 12:00 AM EST) -- The U.S. Equal Employment Opportunity Commission has lost a challenge to revive a lawsuit against Agro Distribution LLC and reverse an order for attorneys' fees, with an appeals court finding the agency's case groundless.

In a decision Thursday, the U.S. Court of Appeals for the Fifth Circuit affirmed an order by a district court that tossed the EEOC's suit under the Americans with Disabilities Act and ordered the agency to pick up Agro's $225,000 legal bill.
