Shuttle Workers' Beryllium Claims Don't Fly: 5th Circ.

Law360, New York (January 16, 2009, 12:00 AM EST) -- Addressing the issue for the first time at a federal appeals level, the U.S. Court of Appeals for the Fifth Circuit has ruled that employees involved in the space program may not pursue damages claims for alleged beryllium sensitization from exposure to space shuttle components, determining that the condition is not a compensable injury under Mississippi law.
