Insurer Must Defend Negligence Claims V. Law Firm

Law360, New York (January 20, 2009, 12:00 AM EST) -- American Guarantee & Liability Insurance Co. has lost a summary judgment bid in its lawsuit against a plaintiffs’ attorney accused of giving more than $3 million in kickbacks to insurance adjusters to settle his clients’ silicosis claims.

The insurance company is seeking a court order declaring it has no duty to defend the law firm of Hoeffner & Bilek LLP and its former partners, Warren Hoeffner and Thomas Bilek, in three lawsuits that arose in connection with Hoeffner’s indictment in the alleged kickback scheme in 2007....
