Monsanto Denied Toss of Herbicide Cancer Lawsuit In Del.
Law360, New York (September 14, 2016, 10:26 PM EDT) -- Toxic tort claims targeting Monsanto Corp.'s mainstay Roundup herbicide survived a dismissal challenge in a Delaware state court Wednesday, with a judge saying the liability complaint's coast-to-coast span can still be fully heard and decided in Wilmington courtrooms.
In the case, filed in October 2015, three individuals blamed their cancers on repeated, multiyear exposures to Roundup at work or in their homes in Oregon, Washington, Michigan and New York. Their complaint cited a recent International Agency for Research on Cancer evaluation last year tagging glyphosate, Roundup's generic reference, as "probably carcinogenic."
