EPA Appeals Board To Review NM Coal Plant Permit

Law360, New York (January 23, 2009, 12:00 AM EST) -- Federal environmental regulators have agreed to review a permit for a controversial coal-fired power plant slated for construction on Navajo land in northwestern New Mexico, in a victory for the state and the slew of green groups that appealed the permit.

On Thursday, the U.S. Environmental Protection Agency's Environmental Appeals Board granted review of the prevention of significant deterioration, or PSD, permit given to the Desert Rock Energy Co. LLC power plant, citing the “relatively complicated and unique” issues raised by petitioners.
