Orion Loses Oil Shale Claims Over Assessment Gaps

Law360, New York (January 26, 2009, 12:00 AM EST) -- An appeals court has upheld a U.S. Department of the Interior decision declaring 156 oil shale mining claims on federal land by Orion Reserves LP invalid because Orion didn't perform annual assessment work, ruling that the trial court failed to consider the effect of a 1970 U.S. Supreme Court ruling when it found the DOI decision capricious.
