Judge Cracks Down On Bar Scanning Patents

Law360, New York (January 26, 2004, 12:00 AM EST) -- A federal judge has ruled against a foundation that has collected $1.5 billion in licensing fees from 978 companies for patents for bar scanning technology.

U.S. District Judge Philip M. Pro ruled that 14 patent claims by the Lemelson Medical, Education & Research Foundation were unenforceable, because the technology had been developed by others as well.

Judge Pro's ruling follows a 27-day bench trial under way from November 2002 to January 2003 in Las Vegas.
