DC Circ. Puts Clean Power Plan Foes, Backers On Hot Seat

Circuit judges wrestled Tuesday with the Obama administration's ambitious plan to slash greenhouse gas emissions at existing power plants, grilling government, industry and environmental attorneys about the new rule's constitutionality and the EPA's authority to craft it.

Before a packed courtroom — and two overflow rooms to accommodate public interest — the judges delved into the arguments presented by state government and power industry groups that have challenged the Clean Power Plan, and those of the federal government and environmental groups, which support it. The U.S. Supreme Court stayed the measure in February, pending the resolution of the litigation....
