Anti-Retaliation Rule Applies To Probes: High Court

Law360, New York (January 26, 2009, 12:00 AM EST) -- In a victory for workers' rights, the U.S. Supreme Court on Monday ruled unanimously that employees who speak out about discrimination during internal company probes are protected under the anti-retaliation provision of Title VII of the Civil Rights Act.

Overturning a U.S. Court of Appeals for the Sixth Circuit decision, the high court said the provision shielded both workers who complain about an unlawful employment practice and those who merely disclose such a practice when quizzed by an internal investigator.
