Caraco Hits Forest Over 3rd Lexapro Patent

Law360 (January 27, 2009, 12:00 AM EST) -- Caraco Pharmaceutical Laboratories Ltd. has filed a new declaratory action against Forest Laboratories Inc. over a third patent for Lexapro in the generics manufacturer's latest bid to market its own version of the depression treatment.

The complaint, filed Monday in the U.S. District Court for the Eastern District of Michigan, seeks a declaratory judgment that Caraco has not infringed U.S. Patent Number 7,420,069, which Forest licenses exclusively from H. Lundbeck A/S.
