Baxter Sues Rival Over Anesthetic Container Patent

Law360 (January 27, 2009, 12:00 AM EST) -- Baxter Healthcare Corp. has sued Minrad Inc. for allegedly planning to make a generic version of Baxter's liquid anesthetic Suprane, which Baxter claims would infringe a Baxter patent.

In a complaint filed Friday in the U.S. District Court for the District of Delaware, Baxter alleges that Minrad has filed an abbreviated new drug application with the U.S. Food and Drug Administration to sell a generic drug containing desflurane, the active chemical in Suprane, which would infringe U.S. Patent Number 5,617,906.
