High Court To Weigh Liability Of Professional Debt Buyers

Law360, New York (October 11, 2016, 5:47 PM EDT) -- The U.S. Supreme Court on Tuesday decided to hear an appeal challenging whether professional debt collectors can face legal liability if they seek to collect on a debt in bankruptcy when they know the statute of limitations for doing so has already expired.

The appeal brought by Midland Funding LLC is challenging an Eleventh Circuit decision from May that revived a lawsuit alleging the company violated a federal law by attempting to collect in Chapter 13 bankruptcy upon an individual's decade-old credit card debt. The case...
