Everglades Limestone Mines Breach CWA: Court

Law360 (February 2, 2009, 12:00 AM EST) -- Major cement producers are reeling after a federal judge halted limestone mining operations in the Everglades, ruling Monday that the U.S. Army Corps of Engineers violated the Clean Water Act when issuing the permits for the massive project.

Considering the case on remand, Judge William M. Hoeveler of the U.S. District Court for the Southern District of Florida again invalidated nine permits the Army Corps of Engineers issued in 2002, ruling that the corps failed to consider practicable alternatives to mining in the wetlands.
