EU Court Adviser Seeks To Trim Schneider Award

Law360, New York (February 3, 2009, 12:00 AM EST) -- An adviser to Europe’s highest court has said French manufacturer Schneider Electric SA should be allowed to recoup some damages after the European Commission mistakenly blocked its 2001 merger with rival Legrand SA, but he has recommended that the court lessen a lower court’s previous award.

In a nonbinding opinion sent to the court on Wednesday, Advocate General Damaso Ruiz-Jarabo recommended that the Court of Justice “set aside” a July 2007 judgment that ordered the European Community to compensate Schneider for two-thirds of the losses caused...
