7th Circ. Rejects En Banc Rehearing In EEOC HIV Case

Law360, New York (February 3, 2009, 12:00 AM EST) -- A majority of judges on the U.S. Court of Appeals for the Seventh Circuit have denied a petition for an en banc rehearing in a case brought by the U.S. Equal Employment Opportunity Commission on behalf of a woman who was allegedly denied employment at a restaurant because of her HIV-positive status.

On Monday, most of the Seventh Circuit denied the EEOC petition for a rehearing en banc, with Circuit Judges Williams, Rovner, Wood and Evans dissenting from the rest of the panel in the case...
