Westar Energy Sued For Alleged CAA Abuses

Law360, New York (February 4, 2009, 12:00 AM EST) -- Federal regulators have jolted Westar Energy Inc. with a lawsuit claiming the utility illegally cranked up operations at a coal-fired plant in Kansas and continues to spew pollution in excess of emissions standards.

The complaint, lodged Wednesday in the U.S. District Court for the District of Kansas, alleges Westar, the state’s largest electric utility, made unapproved modifications to three generating units at a power plant and failed to install up-to-date controls mandated by the Clean Air Act.
