165 Species Won't Be ESA-Listed

Law360 (February 6, 2009, 12:00 AM EST) -- The U.S. Fish and Wildlife Service on Thursday declined a request to list 165 species in the Rocky Mountain region as either threatened or endangered, but did say it would take a deeper look at 39 other species.

The FWS said it would not initiate a further status review for the 165 species because a petition to list the species under the Endangered Species Act, filed by the conservation group WildEarth Guardians, did not present “substantial scientific or commercial information indicating that listing may be warranted.”...
