TVA Spill Violates Clean Water Act: EPA

Law360, New York (February 9, 2009, 12:00 AM EST) -- The U.S. Environmental Protection Agency has notified the Tennessee Valley Authority that a Dec. 22 retention pond breach at its Kingston Fossil Plant that unleashed an avalanche of coal-ash sludge into a nearby river constitutes a violation of the Clean Water Act.

On Wednesday, EPA acting Regional Administrator A. Stanley Meiburg and Paul Sloan, the deputy commissioner of the Tennessee Department of Environment and Conservation, notified TVA of the CWA violation.
